· Statement regarding continuous physical presence
Why does USCIS require a letter of physical presence when adjusting after holding U-status?
Both principal and derivative applicants may file Form I-485 only after they have been physically present in the United States for a continuous period of at least three (3) years since being admitted as a U nonimmigrant. This statement is to document that an applicant has satisfied this requirement.
See www.uscis.gov for detailed information.
Can I customize the template?
Yes. This template is available in ‘word’ format so that you may customize it to your liking.
Use the ‘save as’ feature on MS Word so you can continue to use this template over and over without having to re-purchase this template and to avoid writing over your template.
Does the letter need to be notarized?
No, it is not necessary to notarize this statement. The statement indicates that the applicant is ‘declaring under penalty of perjury’. That is sufficient. Of course, if you want your applicant to notarize it, that’s fine too.
